The following is Flagstaff City Council ordinances passed in the Aug. 18 meeting. Ordinances marked with * will be voted on Sept. 8.
Ordinance No. 2009-19
An ordinance that will amend the City Code by adding a new chapter, titled “User Fees,” to provide for the following: planning fees, engineering fees, fire fees, police fees, recreation fees, city clerk fees, cemetery fees, tax licensing and revenue fees. These fees will help balance the fiscal year 2010 budget by increasing user fees by approximately $500,000.
The ordinance was adopted 4-3 on Aug. 18, with Mayor Sara Presler, Vice Mayor Al White and council members Coral Evans and Karla Brewster in favor and council members Rick Swanson, Joe Haughey and Scott Overton opposing.
Resolution No. 2009-39
A resolution that would redistribute the allocated funds for the Community Development Block Grant (CDBG) for Housing and Economic Development activities into other housing and economic developments of the CDBG activities.
The funds would be distributed as follows: Both Hands, an organization that helps with the finances of adoption, would receive $30,000; Catholic Charities would receive $4,000; Owner Occupied Housing Rehabilitation would receive $10,000; Hozhoni Foundation would receive $4,000; Flagstaff Shelter Service would receive $24,000; and Coconino County would receive $10,000.
The resolution was adopted unanimously.
Resolution No. 2009-40
A resolution that would supersede resolution 2009-26 and permit the redistribution of $19,482.72 from the Community Development Block Grant-Recovery (CDBG-R) to fulfill the Housing and Urban Development (HUD) guidance and requirements. The money would come from the Homeless Shelter-Pre-Development fund and it’s planned to be redistributed to Owner Occupied Housing Rehabilitation.
The Homeless Shelter-Pre-Development activity does not fit the purpose of the American Recovery and Reinvestment Act (ARRA). President Obama’s March 20, 2009 memo, which is guidance from the White House ARRA Implementation Office, indicates certain activities and services are generally inconsistent with the broader purposes of the ARRA.
The resolution was adopted unanimously.
Ordinance No. 2009-32*
A proposed ordinance that would amend Section 6-08-001-0005, under the title “Large Parties, Gatherings or Events.” The main changes the ordinance proposes would concern the time amount of a response notice and the number of people who would be considered a large party.
The first change would be the person(s) responsible for the party to be on response notice for 90 days instead of 12 hours. The second proposition would be to change the amount of people considered a large party from a five-person gathering to a 15-person gathering.
This ordinance would only be considered for private venues such as house parties and apartment complexes.
Resolution No. 2009-43*
A resolution approving amendments for the City Council’s Rules of Procedures concerning tie voting. One possible change is the motion of reconsideration would not take place at the same meeting, due to the high probability of getting another tie vote.
Another change that would be considered is any member who was present or not for the vote would be able to make a motion to reconsider the defeated motion on a tie vote.
